No. 03-16

 

A RESOLUTION AUTHORIZING AND ADOPTING AN

EMPLOYEE SHARED LEAVE PROGRAM

 

 

WHEREAS, one of the benefits now offered to Cowley County employees, pursuant to the Cowley County Personnel Policy Handbook, is sick leave and vacation; and

 

WHEREAS, Cowley County does not presently have a policy regarding the sharing of sick leave and vacation between employees; and

 

WHEREAS; a shared leave program is a means to transfer vacation and sick leave to a qualifying employee experiencing, either personally or by a family member, a serious, extreme, or life-threatening illness, injury, impairment or physical or mental condition which has caused, or is likely to cause, the employee to take leave without pay or cause a termination of employment; and

 

WHEREAS, the Board of Cowley Commissioners of Cowley County has deemed the adoption of a shared leave program to be in the best interest of the County and its employees.

 

BE IT THEREFORE RESOLVED that the Shared Leave Policy shall be made a part of the Cowley County Personnel Policy Handbook.

 

BE IT FURTHER SESOLVED that the Shared Leave Policy set forth in Memorandum 05-03 is hereby adopted as the Shared Leave Policy, said Memorandum being incorporated herein by referenced.

 

That this Resolution shall be effective upon its publication in the official newspaper.

RESOLUTION IN SUPPORT OF

THE COMMUNITY CAPACITY BUILDING PROGRAM

US 77 HIGHWAY CORRIDOR STUDY

ARKANSAS CITY/WINFIELD. KANSAS

 

A resolution of the Board of County Commissioners of Cowley County , Kansas , supporting the application of the Cities of Arkansas City and Winfield for the Community Capacity Building rant program administered by the Kansas Department of Commerce.

 

WHEREAS, the Cities of Arkansas City and Winfield are seeking to conduct a corridor study along US 77 Highway between these two cities, including he Strother Field Airport/Industrial Park complex; and

 

WHEREAS, the anticipated development of this corridor will have amajor economic impact on the future of Cowley County relative to industrial and commercial development, health care and governmental facilities, residential growth and safety issues within the US 77 Highway corridor; and

 

WHEREAS, the Kansas Department of Commerce offers the Community Capacity Building grant program to encourage collaborative community development palnning and plan implementation activities in non-metroploitan areas such as this throughout the State; and

 

WHEREAS, support from the Community Capacity Building Program is essential to the complete and comprehensive execution of this corridor study;

 

THEREFORE. The Board of County Commissioners of Cowley County , Kansas , supports and endorses the application of the Cities of Arkansas City and Winfield for funding through this program and appreciates the consideration of the Kansas Department of commerce in this matter.

RESOLUTION NO.03-14

 

A RESOLUTION LIMITING COWLEY COUNTY EMPLOYEE

PAYROLL DEDUCTIONS PLANS

 

WHEREAS, there are currently eleven (11) companies selling services to  Cowley County Employees for which the County is providing payroll deductions and preparing monthly payment checks to those companies; and

 

WHEREAS, the number of County employees currently enrolled in these private offered employee benefit programs varies from one (1) employee in one program to thirty-two (32) employees being enrolled in another program; and

 

WHEREAS, although such services and products are good and desirable benefits to the employees who choose them. The payroll deduction procedure results in a cost and inconvenience to the County Payroll and Finance Department; and

 

WHEREAS, the Commission has deemed it advisable to establish a minimum level of participation by County employees prior to permitting any additional private companies to make its services available to County Employees through employee payroll deductions; and

 

WHEREAS, in past years, the County has allowed private companies offering employee benefit programs meet with County employees during those employees’ work periods and that permitting such contact during the employees’ work periods, may have a detrimental effect on the work product of the County employees; and

 

WHEREAS, the County Commission has deemed it advisable to establish a policy prohibiting contact with County employees during those employees’ work periods.

 

NOW, THEREFORE. Be it Resolved by the governing Board of Cowley County, Kansas that:

 

  1. The payroll deduction services now provided by the County shall be limited to the current eleven (11) companies selling services to County Employees . That no additional payroll deduction services with the County will be accepted for any additional companies unless at least twenty-five percent (25%) of the then existing County employees have elected to participate in that company’ serevices.

 

  1. In the event any of the eleven (11) companies currently selling services to the County employees or in the event any additional company desires to consult with any County employees, such companies shall not be permitted to consult with County employees during the employees’ work periods. Such company shall be permitted to receive from the employee, a written permission provided on a standard form, providing a list of employees willing to be contacted on their off work time.
  2. That County facilities will be made available for presentations to County employees desiring to consult with such company or companies provided the use of County facilities are either before or after regular work hours and that such use of the County facilities will not otherwise interfere with County functions and operations.
  3. That nothing herein shall be construed as removing the privilege of the current eleven (11) companies selling services to County employees to continue to collect premiums through employee payroll deductions.

 

THIS Resolution shall become effective upon its publication in the official County newspaper.

At a regularly scheduled meeting of the board of County Commissioners of Cowley county, Kansas, held on           it was, upon the motion duly made, seconded and unanimously adopted,

 Resolved, that pursuant to K. S. A.75-5297 and 5298, the following-named persons are appointed as members of the advisory board of Cowley county community Corrections, each for a term of two years commencing on theis date and continuing until his or her successor is duly appointed:

RESOLUTION NO. 03-12

 

WHEREAS, pursuant to Resolution No. 89-15, the Board of County Commissioners of Cowley County, Kansas created a County Equipment Reserve Fund to finance the acquisition of equipment and to transfer funds into the County Equipment Reserve Fund for individual departments within Cowley County for the use and acquisition of equipment pursuant to K.S.A. 19-119; and

 

WHEREAS, due to funding constraints, including the diminution of tax revenues from the State of Kansas, the Board of County Commissioners have sought to avoid any tax increases for the 2004 budget year; and

 

WHEREAS, the Board of County Commissioners have examined the current balances in the various equipment reserve funds and have determined that some funds have balances greater that the projected equipment needs of such departments ant that the creation of a cap on such equipment funds will further the Board of County Commissioners’ goal of providing for efficient operation of the County without andy substantial tax increase.

 

            NOW, THEREFORE, BE IT RESOLVED:

  1. That effective January 1, 2004 the maximum balance in each of the County’s equipment reserve funds, excepting the equipment reserve fund of the road and bridge department, the funds in excess of Fifty Thousand ($50,000.00) dollars in the various equipment reserve funds are not needed for the purposes for which the same were budgeted and transferred.
  2. That effective January 1, 2004 , the fund balances in the various equipment reserve funds in excess of Fifty Thousand ($50,000.00) dollars, excluding the road and bridge reserve equipment fund, shall be transferred to the general operating departmental fund from which such surplus funds came.
  3. That in the event any department of the County, except the road and bridge department, has a surplus cash balance at the end of it’s budget year, such surplus cash balances may be transferred to that department’s equipment reserve fund, provided such transfer does not cause the equipment reserve fund to exceed Fifty Thousand ($50,000.00) dollars.
  4. The Board of County Commissioners hereby acknowledge that due to the ongoing equipment needs of the road and bridge department and the substantially greater costs of such equipment, he imposition of a Fifty Thousand ($50,000.00) dollar cap on the reserve equipment fund of the road and bridge department will not be in the best interest of the County. Therefore, nothing set forth in this resolution shall bee construed as creating a cap on the amount of funds that may be budgeted or transferred to the road and bridge equipment reserve fund.
  5. That this resolution shall amend and supercede Resolution NO 89-15.
  6. That this resolution shall be effective upon publication in the official county newspaper

RESOLUTION 03-11

 A RESOLUTION ESTABLISHING THE DUTIES OF AND DELEGATING RESPONSIBILITIES TO THE COUNTY ADMINISTRATOR

WHEREAS, Cowley County , Kansas , has established the position of County Administrator ;

WHEREAS, it is the desire of the Board of County Commissioners to establish the duties of and to delegate responsibilities to the County Administrator ;

IT SI HEREBY RESOLVED that the County Administrator shall serve as the chief administrative officer of Cowley County at the direction of the Board of County Commissioners and shall be responsible for the effective administration of all governmental affairs of Cowley County which shall be placed under his charge by the County Commission as stated below:

  1. As directed by the Board, set the agenda for all Commission meetings, attend said meetings, and advise and make recommendations to the Board on matters within his administrative authority.
  2. Serve as, or designate another to serve as, the purchasing officer for County operations in conformance with Kansas statutes and policies adopted by the Board.
  3. As directed by the Board, prepare and propose an annual County budget to the Board and be responsible for the administration of the adopted budget.
  4. Be responsible for all County property, its maintenance, and the risk management programs related thereto.
  5. Act as Personnel Administrator, and , in such capacity:
    1. Employee and terminate all County employees except for those employees employed or terminated by an elected official of the County;
    2. Prepare and revise a Position Classification Pay Plan and a Handbook of Personnel Rules and Regulations for all eligible County employees, subject to the Board’s adoption;
    3. Administer said Pay Plan and Personnel Rules and Regulations;
    4. Establish and maintain personnel files and records for each County employee; and
    5. Establish procedures to provide training programs for County employees and maintain good employee relationships.

             6 Authorize employee attendance at meetings in conformance with adopted County policies.

            7 Appoint employee committees as necessary and appropriate to review and advise the Board and Administrator on organizational issues.

            8 Prepare, or delegate the preparation of plans, policies, manuals, contracts, and other documents to be submitted to the Board for review and approval.

            9 Serve as the County’s representative on boards and commissions and as the County’s intermediary with other public jurisdictions and their representatives, legislative groups, and news media, subject to the directives of the Board.

            10 Make recommendations and propose policies within county government to the Board.

            11 Perform other duties as may be assigned by the Board.

            12 That this Resolution shall supercede paragraph 3 of Resolution 03-05

County Reconfirmation of Economic Development Organization

RESOLUTION  03-10

A RESOLUYION reconfirming that a regional economic development organization has been established as required by the 74-50-116© (1), for the purpose of qualifying the County of Cowley as a designated nonmetropolitan business region.

WHEREAS, A regional economic development organization known as the Cowley County Economic Development Agency has been established; and

WHEREAS, the Cowley County Economic Development Agency continues its operation under an Interlocal Cooperative Agreement Providing for the Creation and Operation of the Cowley County Economic Development Agency” as most recently entered into on the 3rd day of December, 2001, by the Cities of Arkansas City and Winfield and the Cowley County Community College; and

WHEREAS, this “Interlocal Cooperation Agreement for the creation and Participation in the Cowley County Economic Development Agency” was approved in accordance with KSA 12-2901 et seq. on the 21st December, 2001 by the attorney General of the State of Kansas, and

WHEREAS the CCEDA Board of Directors has a membership representative of all geographic areas of the County of Cowley ; and

WHEREAS, the Cowley County Economic Development Agency has a membership representative of all types of businesses and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Cowley : That the Cowley County Economic Development Agency meets the requirements of KSA74-50-116(c) (1); and

BE IT FURTHER RESOLVED: That the Kansas Secretary of Commerce & Housing is hereby requested to acknowledge Cowley County Economic Development Agency as a qualifying regional economic development organization for the purpose of reapproving County of Cowley as a designated nonmetropolitan business region.

WHEREAS, the County of Cowley, Kansas, intends to submit an application for assistance from the 2003 U.S. Small Cities Community Development Block Grant Program for the creation of 30 new jobs in Cowley County, Kansas .

 

            THE APPLICANT hereby certifies that the County of Cowley , Kansas is a legal governmental entity under the status of the laws of the state of Kansas and thereby has the authority to apply for assistance from the 2003 U.S. Small Cities Community Development Block Grant Program.

 

            THE APPLICANT hereby authorizes the CHAIRPERSON  of the Cowley County Commission, Cowley county, Kansas , to act as the applicant’s official representative in signing and submitting an application for the assistance to the 2003 U.S. Small Cities Community Development Block Grant Program

BE IT RESOLVED by he Board of Cowley Commissioners of Cowley County, Kansas that the Board of County Commissioners of Cowley County, Kansas be authorized to enter into an Interlocal Agreement with Butler, Harper, Harvey, Marion, Reno, Sedgwick, and Sumner Counties, for the creation of an entity titled South Central Metro Region (SCMR) and which entity is being created for the purpose of developing, implementing and evaluating a regional initiative for mutual assistance and for the enhancement of the delivery of services and resources as related to the Kansas Department of Health and Environment Public Health Preparedness and Bioterrorism Grant.

 

BE IT FURTHER RESOLVED that the Interlocal Agreement between Cowley County, Kansas and Butler, Harper, Harvey, Marion, Reno, Sedgwick, and Sumner Counties, Kansas shall be effective upon the publication of this resolution in the official County newspaper or upon the last date upon which any of said Counties has published it’s resolution approving the creation of the Interlocal Agreement, or upon the date this agreement has been approved by the Kansas Attorney General, whichever occurs last.

No. 03-05

CREATING THE POSITION AND

ESTABLISHING THE DUTIES AND RESPONSIBILITIES OF

COWLEY COUNTY ADMINISRATOR

 

            WHEREAS, K.S.A. 19-101 et seq, as amended, authorizes the Board of county commissioners of Cowley County, Kansas to exercise the powers of home rule to determine it’s local affairs and government; and

 

            WHEREAS, K.S.A. 19-3a01, as amended, authorizes the Board of County Commissioners of Cowley County, Kansas to appoint a county administrator and to provide for the compensation and duties of said administrator; and

 

            WHEREAS, the administrator functions of county government can be implemented with maximum efficiency and service to the public through sensible and economical administrative practices supervised by a county administrator f professional stature, experience, judgment and training.

 

            NOW, THEREFORE, BE IT RESOLVED that the qualifications, salary, benefits and duties of the County Administrator are hereby established as hereinafter set forth:

 

  1. Minimum qualifications:

 

    1. Graduation from an accredited four year college or university and a master’s degree in business or public administration, planning, or related field; Five or more years progressively responsible experience in local government administrative or any equivalent combination of training and experience which provides the knowledge, skills and abilities as listed in the other qualifications.
    2. Thorough knowledge of governmental budgeting and the principals of reorganization, management and supervision.
    3. Thorough knowledge of the principles, practices and techniques of public administration.
    4. Through knowledge of the structure, functions, operations, policies and procedures of county government and intergovernmental relations.
    5. Thorough knowledge of research methods and techniques as they apply to governmental operations.
    1. Ability to provide effective leadership, emphasizing a team concept, and coordination in developing solutions, recommending new techniques, and supervising staff procedures.
    2. Ability to plan and coordinate a diverse number of activities simultaneously.
    3. Ability to communicate effectively, both orally and in writing.
    4. Ability to prepare, present, and interpret complex reports, such as legal documents, bond issues, policy statements, budgets and manuals.
    5. Ability to establish and maintain effective working relationships with County Commissioners, County Department Heads, County employees, City agents and employees, other public officials, and the general public.
    6. Demonstrate skill in negotiation. Knowledge of collective bargaining process.
    7. Demonstrates proficiency in the use of personal computers for word processing and spreadsheet analysis. Prefer experience in operation of IBN AS400.
    8. Ability to interpret fiscal trends to develop and manage the budget.
    9. Maintain professional standards of ethics and integrity.
    10. Ability to analyze facts and to make sound judgments while administrating County’s General Administrative Services.
    11. Ability to listen to information and instructions and apply them to new situations required when coordinating County Commissioners assignments and requests.
    12. Ability to recall information, after having opportunity to study is, is essential when researching operational and administrative issues.
    13. Ability to solve arithmetic problems involving operations with whole numbers, decimals, percents, and simple fractions for planning, preparing and monitoring budget.
    14. Ability to read and understand legal documents and statues.
    15. Ability to communicate ideas by means of the spoken wor. Such as giving assignments or directions.
  1. Salary and benefits:

      The salary of the County Administrator shall be fixed annually by the Board of County Commissioners and the administrator shall be entitled to all benefits conferred on other county employees.

  1. Duties:
    1. Attend all meeting of the Board of County Commissioners, and present proposed policies, programs and plans aimed at addressing overall county needs for review, revision and approval by the board;
    2. Present an annual recommended operating budget, capital improvements program and long-range strategic plan for all county operations for review, revision and adoption by the Board of County Commissioners;
    1. Identify and recommend individuals to the Board of County Commissioners for appointment to boards and commissions;
    2. Recommend individuals to the Board of County Commissioners for appointment to offices for which the board is the appointing authority by law. Evaluate and recommend the compensation, suspension or dismissal of such appointed administrative officers;
    3. Coordinate and supervise the administrative operations of the departments of all officials appointed by the Board of County Commissioners. All offices and employees therein shall be administratively responsible to the County Administrator ;
    4. In conjunction with the Board of County Commissioners, prepare the meeting agenda of the board;
    5. Coordinate the administrative services of county departments and agencies, offices of eledted officials, advisory and governing boards appointed by the Board of County Commissioners. Provide technical assistance to such departments, offices, agencies and boards as needed;
    6. Coordinate county programs and operations with other local governmental units, federal and state governments and other governmental and nongovernmental entities;
    7. Supervise, evaluate and recommend the compensation and discipline of personnel of the Board of County Commissioners;
    8. Execute contracts and other documents as approved by the Board of County Commissioners;
    9. Approve the appointment, compensation, discipline and change in status of personnel in the departments of all officials appointed by the Board of County Commissioners. All employees affected by such decisions shall continue to have access to all appellate and other rights granted ehem by county personnel policies:
    10. Monitor and provide regular reports to the Board of County Commissioners concerning adherence by county departments to the personnel, purchasing, budget, accounting and other administrative policies of the board; and
    11. Perform such other duties as shall be lawfully delegated by the Board of County Commissioners.

 

BE IT FINALL RESOLVED that this Resolution shall become effective upon passage and publication in the official county newspaper.

A Resolution Imposing Limitations on the Filling of Job Vacancies

 

            WHEREAS, various job positions within Cowley County are currently vacant and it is expected that additional job vacancies will hereafter aris; and

 

            WHEREAS, in establishing the budget for Cowley county, Kansas for the 2003 calendar year, the Board of County Commissioners factored in various revenue sources and revenue sharing from the State of Kansas ; and

 

            WHEREAS, the State of Kansas has heretofore announced cuts in the revenue sources and revenue sharing to Cowley county, Kansas and it is anticipated that there will hereafter be further cuts; and

 

            WHEREAS, The Board of County Commissioners deems it advisable to take a proactive approach in dealing with the revenue cuts and the consequential revenue shortfalls.

 

            NOW THEREFORE, be it resolved by the Board of County Commissioners of Cowley County , Kansas :

 

  1. Until the further order of the Cowley County Commission, no vacant County job position, whether now existing or to hereafter arise, shall be filled without the prior approval of the Cowley County commission.
  2. That this resolution shall take precedence over any conflicting provisions set forth in the Cowley County Personnel Policy Handbook.
  3. That this Resolution shall take effect upon its publication in the official County newspaper.

No. 03-03

 

A RESOLUTION IMPOSING LIMITATIONS ON AUTHORIZING OVERTIME WORK

 

            WHEREAS, the Board of County commissioners of Cowley County, Kansas has heretofore adopted the Cowley County Personnel Policy Handbook which governs various employer-employee matters, including provisions relating to overtime work by County employees; and

 

            WHEREAS, Section 7.10 of the Personnel Policy Handbook provides in part that “payment for overtime worked shall be limited to non-exempt employees and shall be authorized in advance by the respective department head”, and

 

            WHEREAS in establishing the budget for Cowley County, Kansas for the 2003 calendar year, the board of County Commissioners factored in various revenue sources and revenue sharing from the State of Kansas; and

 

            WHEREAS, the State of Kansas has heretofore announced cuts in the revenue sources and revenue sharing to Cowley County, Kansas and it is anticipated that there will hereafter be further cuts; and

 

            WHEREAS, The Board of County Commissioners deems it advisable to take a proactive approach in dealing with the revenue cuts and the consequential revenue shortfalls.

 

            NOW THEREFORE, be it resolved by the Board of County Commissioners of Cowley County , Kansas :

 

  1. Until the further order of the Cowley County Commission, no overtime work by County employees shall be authorized or performed, except as hereinafter provided.
  2. Overtime work by County employees may be authorized and performed under the following circumstances:

 

    1. Prior approval for the overtime work has been given by the County Commission .
    2. With respect to Sheriff’s Deputies and Cowley County Jail Corrections Officers, the Cowley County Sheriff deems overtime work necessary for those deputies and corrections officers to fulfill their job duties.
    3. With respect to road and bridge employees, the Cowley County Engineer deems overtime work necessary for those employees to protect and safeguard the general public from hazardous conditions such as icy roads or bridges, damaged bridges or damaged road signs.

 

  1. That this resolution shall take precedence over any conflicting provisions set forth in the Cowley County personnel Policy Handbook.
  2. That this Resolution shall take effect upon its publication in the official County newspaper

RESOLUTION

No. 03-1

 

            WHEREAS, the Board of County Commissioners of Cowley County , Kansas , has heretofore established a Multi-Year Capital Improvement Plan providing for the transfer of monies from other county funds for improvement purposes to the Capital Improvements Fund and other available revenues as authorized by K.S.A. 19-120, with said fund having been created by Resolution No. 91-8, and

 

            WHEREAS, pursuant to Resolution Nos. 98-9 and 98-10, amendments to the Multi-Year Capital Improvement Plans and funds to provide for aother capital improvements to Cowley County facilities.

 

            NOW, THEREFORD, be it resolved by the Board of County Commissioners of Cowley County , Kansas :

 

1.               That the Multi-Year Capital Improvement Plan and Capital Improvement Funds heretofore created and amended by Resolution Nos. 91-8, 98-9 and 98-10 are hereby amended to provide that the Capital Improvement Funds may be used to finance, in whole or in part, public improvement needs for Cowley County owned facilities, including the construction, repair, restoration and rehabilitation of and district shops and which capital improvements may include the construction of security fencing and restroom facilities.

2.               That no charges shall be made to the Capital Improvement Funds without the prior approval of the Board of County Commissioners.

3.               This Resolution shall remain in effect until the same is amended or canceled by a subsequent resolution

4.               This Resolution shall become effective upon it’s publication in the official county newspaper.
